1. Eligibility and your warranties

You must be at least 18 years of age. By ordering you warrant that you are 18 or over, that you are a qualified researcher or purchasing on behalf of a laboratory or research organisation, and that every product you buy will be used solely for in-vitro laboratory research and development.

You warrant that you will not administer, or permit anyone else to administer, any product to a human or animal; will not use any product for any therapeutic, diagnostic, cosmetic, food or consumptive purpose; will not resell products for any such purpose; and will store, handle and dispose of products safely and in accordance with all applicable laws and safety data.

We may ask for evidence of these matters and may refuse, cancel or limit any order at our discretion, including where we consider that a product is not intended for legitimate research use. You must indemnify us against any claim, loss or penalty arising from your breach of these warranties.

2. Research use only; no medical claims

Our products are chemical reagents supplied for laboratory research only. They are not drugs, medicines, foods, cosmetics, supplements or medical devices, and none of them is registered, listed or approved by the Therapeutic Goods Administration (TGA) or any other regulator for use in humans or animals.

Nothing on this site, in our blog, in our communications or on our packaging is medical, health or dosing advice, or a claim that any product is safe or effective for any use in humans or animals. Product information describes research context only.

3. Products, descriptions and pre-orders

Purity, identity and quantity are as stated on the Certificate of Analysis (COA) for the specific batch supplied, which we provide to qualified researchers on request. Figures such as "≥99% purity" summarise our specification; the batch COA is the authoritative record and results can vary between batches within specification.

Product images are illustrative. Vial labels, packaging and fill volumes may differ from images.

Items marked "pre-order" are not in stock when you order. We will tell you the expected timing where we can, and you may cancel a pre-order for a full refund at any time before dispatch. If we cannot supply within a reasonable time we will offer a full refund or a substitute of your choice.

4. Orders, pricing and acceptance

All prices are in Australian dollars. Prices, availability and specifications may change without notice, but the price shown when you place your order is the price you pay. Shipping is charged as shown at checkout.

Your order is an offer to buy. We accept it when we confirm that your payment has cleared. Until then we may decline or cancel the order for any reason, including pricing or stock errors, suspected misuse or fraud, or delivery restrictions, and we will refund any amount paid.

Discount codes and referral codes apply only as described at checkout, cannot be exchanged for cash, may be limited or withdrawn at any time, and do not apply to items already on promotional pricing unless we say otherwise.

5. Payment

We accept payment by PayPal invoice and cryptocurrency, and card payments through our payment provider when that option is shown at checkout. PayPal payments are also subject to PayPal's user agreement. Orders are held until payment is received and verified; if payment is not received within 7 days we may cancel the order.

For cryptocurrency payments the amount due is the Australian-dollar total at the time of the order, and you are responsible for network fees. Any refund of a cryptocurrency payment is made at the Australian-dollar value paid.

6. Shipping, delivery and risk

We dispatch tracked parcels from Melbourne, Australia to addresses within Australia. Delivery timeframes are estimates and not guaranteed. You are responsible for providing a complete, correct delivery address and for any costs caused by an incorrect address.

Risk in the products passes to you when the parcel is delivered to the address you gave. Title passes when payment clears. If a parcel is lost or confirmed undelivered we will replace or refund it as set out in our Refunds & Returns Policy; the optional reshipment guarantee offered at checkout provides one reshipment at no further cost.

7. Refunds, returns and consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Because research reagents are sensitive to temperature, handling and contamination, we do not accept returns for change of mind once an order has been dispatched. How to make a claim for a damaged, incorrect or faulty item, cancel before dispatch, or deal with a lost parcel is explained in our Refunds & Returns Policy.

8. Referral and affiliate program

We issue referral codes to approved affiliates. A reward becomes payable only when a referred order is confirmed as paid and is not later cancelled or refunded. Rewards are as described in the affiliate's dashboard and may be changed for future orders on notice. Self-referrals, fake orders, misleading or unlawful promotion, and any claim that our products are for human or animal use will result in forfeiture of rewards and removal from the program.

Affiliates are independent and are not our agents or employees. Affiliates must comply with all applicable law, including the Australian Consumer Law and any requirement to disclose that they may earn a commission.

9. Accounts and acceptable use

You are responsible for keeping your login details secure and for activity under your account. Tell us immediately if you suspect unauthorised access.

You must not use the site for any unlawful purpose, attempt to interfere with its operation or security, scrape or bulk-copy its content, submit false information, or place orders you do not intend to pay for.

10. Intellectual property

The site, its design, text, product renders, logos and other content are owned by or licensed to Peptastic Labs and protected by copyright and trade mark law. You may view and print pages for your own research reference but may not otherwise reproduce, distribute or commercially exploit them without our written permission. Blog articles may be shared by linking to them.

11. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law: we are not liable for any loss arising from your use or misuse of a product contrary to section 1; our total liability for any claim relating to an order is limited to the price you paid for the relevant products or, at our election, resupplying them; and we are not liable for indirect or consequential loss, loss of profit, or loss of data.

12. Privacy

We handle your personal information as described in our Privacy Policy, which forms part of these terms.

13. Changes, governing law and contact

We may update these terms from time to time. The version on the site when you place an order applies to that order. Continued use of the site after a change means you accept the updated terms.

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria. If any part of these terms is unenforceable the rest continues to apply. Questions: research@peptasticlabs.info.
